The Music Licensing Issue
Australian Copyright Tribunal delivers verdict

Australian clubs will be assessed a fee of $15 per class or $1 per participant as a result of the Australian Copyright Tribunal’s decision to award higher copyright fees from fitness centres to the Phonographic Performance Company of Australia (PPCA). Currently, Australian clubs pay 96.8 cents per fitness class with an annual capped maximum of $2,654. Fitness Australia said that the ruling will result in an increase of 1,500% for a PPCA license in the typical fitness centre.

The verdict comes after two-year case pressed by Fitness Australia and supported by IHRSA, Fitness First, Les Mills International, and the Australian club industry. The PPCA had originally proposed an average increase of 3,172% per club, suggesting that clubs pay either $31.67 per class with no cap, or that clubs be charged a rate of $26.08 per member per month.
